Terms of Use

Effective date: October 26, 2026

These Terms of Use apply to the Kansas Ultrarunning Historical Foundation and its related websites, including KansasUltrarunningHistory.org, KansasUltraRaces.com, KansasUltraRunners.com, and any companion domains that redirect to or support those sites. By using these websites, you agree to these terms.

Purpose of the Websites

The Foundation websites are provided for historical, educational, archival, research, and informational purposes. They may include race records, runner records, performance data, race editions, organization histories, photographs, stories, articles, timelines, source material, commentary, and user-submitted materials.

Accuracy and Historical Records

We work to preserve and present information accurately, but historical records may be incomplete, conflicting, incorrect, uncertain, or subject to later correction. Information on the Foundation websites should not be treated as a guaranteed or official certification of any performance, identity, result, event, organization, or historical claim unless expressly stated otherwise.

Permitted Use

You may use the websites for lawful personal, educational, historical, journalistic, research, and informational purposes. Ordinary search-engine indexing, linking, citation, and reasonable research access are permitted where otherwise lawful and technically allowed.

You may not interfere with website operation, attempt unauthorized access, circumvent access or security controls, evade rate limits, submit knowingly false or unlawful material, overload or disrupt the services, use automated systems in an abusive manner, or use the websites in a way that violates applicable law or the rights of others.

Email Reports and Verification

The Foundation may allow users to request reports by email from supported runner, race, race-edition, organization, or other record pages. A valid email address and verification step may be required before delivery. Verification links may be time-limited and single-use, and rate limits or other safeguards may be applied to recipients, IP addresses, or the system as a whole.

Email reports are provided as a convenience, may not be delivered in every case, and reflect the Foundation database at the time the report is generated. They are not official certifications and may become outdated if the live historical record is later corrected or expanded. Attempts to bypass verification, rate limits, abuse controls, or delivery safeguards are prohibited.

Newsletter Opt-In

Where a report request, submission form, or other page offers an optional newsletter subscription, choosing that option is voluntary and separate from the underlying request. Newsletter subscriptions may be canceled through the unsubscribe mechanism provided with those communications.

Submissions

By submitting records, corrections, photographs, documents, stories, recollections, source material, or other content, you represent that the information you provide is truthful to the best of your knowledge and that you have the right to provide the submitted material.

Unless otherwise agreed in writing, and only to the extent you hold or can grant the relevant rights, you grant the Foundation a nonexclusive, royalty-free license to receive, store, reproduce, digitize, format, edit for clarity or presentation, excerpt, display, archive, preserve, and publish submitted material for historical, educational, archival, research, and Foundation-related promotional purposes, subject to the rights, attribution, and reproduction choices accepted through the submission process. Ownership does not transfer merely because material is submitted.

Receiving third-party historical material for evaluation or research is separate from publicly reproducing it. Identify known creators, rights holders, permissions, restrictions, and uncertainties honestly; do not claim rights you do not hold. Submission alone does not establish permission to publish third-party material. Public reproduction remains subject to the Foundation’s rights review, published methodology, applicable law, and any separate permission required.

Submission does not guarantee acceptance, publication, correction, attribution, research, response, return of materials, or inclusion in the verified database. The Foundation may request additional evidence, retain material for future research, decline a submission, or revise the historical record when stronger evidence becomes available.

Submission Process and Communications

The published submission system is the Foundation’s official channel for corrections, historical contributions, volunteer interest, and related inquiries. A submission does not create a support ticket, guaranteed response, status-update obligation, or continuing correspondence relationship.

When a question does not reasonably fit the four substantive submission categories, the General Inquiry option may be used. General Inquiry is not a way to bypass evidence requirements, published methodology, or category-specific submission standards.

Intellectual Property

Unless otherwise indicated, Foundation-created text, branding, design elements, original compilations, database presentation, and other original materials are owned by or licensed to the Kansas Ultrarunning Historical Foundation. Historical facts themselves are not claimed as proprietary merely because the Foundation has researched or published them. Third-party names, photographs, records, documents, trademarks, and copyrighted works remain the property of their respective owners.

Third-Party Sources and External Services

The websites may link to, cite, summarize, or integrate with third-party websites, services, databases, analytics platforms, payment providers, social networks, archival sources, or email systems. The Foundation does not control and is not responsible for third-party content, availability, security, terms, or privacy practices.

Donations and Transactions

Donations are processed through Stripe-hosted checkout and may be subject to Stripe’s applicable terms and privacy practices. Confirm the contribution amount and whether it is one-time or monthly before completing checkout. A monthly contribution repeats until canceled; use the private management link provided in your confirmation email to manage or cancel future contributions. If that link is unavailable or expired, contact the Foundation through the published inquiry process. Cancellation stops future recurring contributions and does not itself refund prior payments.

Unless otherwise required by law or expressly stated, donations are generally nonrefundable. Founding Donor eligibility and recognition periods are described on the Support the Foundation page. Public name or logo recognition is optional, subject to review and the donor’s choices; footer recognition requires separate permission. A contribution does not purchase influence over historical verification, record eligibility, research findings, or editorial decisions.

Public Beta and Downloads

Public beta access means the websites remain under active development and review. Features and content may change, and the historical record remains open to evidence-based correction. Downloadable publications are provided for informational and educational use, remain subject to the intellectual-property terms above, and may be superseded by later editions or live records.

Availability and Changes

The Foundation may add, modify, suspend, restrict, or discontinue website features, records, reports, forms, access methods, or other services at any time. We may also revise records and historical content as new evidence or corrections become available.

No Warranty

The websites, reports, records, forms, and related services are provided on an “as is” and “as available” basis without warranties of any kind to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, the Kansas Ultrarunning Historical Foundation and its officers, volunteers, contributors, agents, and service providers will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of or reliance on the websites, reports, historical records, submissions system, third-party material, or related services.

Changes to These Terms

We may modify these Terms of Use as the Foundation websites and services evolve. The effective date above will be updated when material changes are made. Continued use of the websites after revised terms are posted constitutes acceptance of those terms.
